Mandatory health insurance certificate: 2025 guide | MIA Assurances

The mandatory health insurance certificate proves that an employee is covered by the company’s group health plan. It is mainly used to terminate an individual health policy, justify an exemption from enrollment, and comply with URSSAF audits.

Are you an employer?

To benefit from social security contribution exemptions on your employer share, you must prove that your group plan meets legal requirements. This means:

  • Subscribing to a compliant plan covering all employees (and possibly their dependents).
  • Keeping supporting documents in case of exemptions (written request + certificate).

During a URSSAF audit, you must be able to explain each exemption. A mandatory health insurance certificate signed by the employee is essential.

Are you employee?

If you join the company health plan but already have an individual policy:

  • After one year: cancellation is possible at any time (Hamon law).
  • Before one year: you must provide a mandatory health insurance certificate to justify early termination.

Ask your employer for this document: it must state that the group plan is mandatory.

Exemption cases (updated 2024):

  • Covered by your spouse’s health plan (even if dependent coverage is optional).
  • Already covered by an individual policy (until its expiration).
  • Short-term contracts, apprentices, CSS beneficiaries.

Each exemption must be documented in writing and accompanied by a certificate.
